CampaignBoston Herald: Geoff Diehl calls on Charlie Baker to repeal Oct. 17 vaccine mandate

GOP gubernatorial candidate Geoff Diehl is calling on the Baker administration to repeal the Oct. 17 vaccine mandate for state workers after the Herald reported a State Police sergeant is in the ICU.

What landed the officer in the intensive care unit at Brigham and Women’s Hospital in Boston is not being divulged, the story states. Diehl said the sergeant was “hospitalized” after receiving “the single Johnson & Johnson vaccine injection on Friday.”

Gov. Charlie Baker instituted a vaccine mandate for all Executive Branch employees Aug. 19 with a deadline of Oct. 17 to be fully vaccinated or face being suspended without pay and then fired.

“First of all, I am praying for this hero and for his family,” said Diehl in a release just before midnight.

“This was a choice that the Trooper never should have had to make and I demand that the Baker/Polito administration immediately revoke the vaccine mandate. People who have developed natural immunity, or who recognize that this vaccination will put them at a greater health risk, should not be forced to choose between their livelihood and a capricious executive order tied to an arbitrary timetable,” the Whitman Republican said.

Diehl also rips the law vaccines mandates lean on — Jacobson v. Massachusetts — where a Swedish-born Lutheran minister who moved to Cambridge was fined $5 in 1905 for not updating his smallpox vaccine. The minister claimed he and his son “suffered adverse reactions” to the vaccine. The case went all the way to the U.S. Supreme Court where the minister lost and madates won.

“The Jacobson case law cited by the Administration as providing the legal authority is 116 years old and fails to be relevant,” Diehl added last night.

Baker’s spokesman has said the administration is following the science in mandating the vaccination against the coronavirus.

Diehl, however, said it’s time to scrap the mandate.

“The Baker/Polito administration is putting lives directly at risk,” said Diehl. “The fact that they are calling up the National Guard to replace the scores of law enforcement, corrections officers and others about to be fired, simply for trying to protect their personal health, creates further public safety risks and is unconscionable.”

He ends with: “The Governor needs to repeal the mandate immediately and restore lost jobs to any state workers who have been fired or who have submitted their resignation under duress.”
